Completing DMRE Declarations are essential in developing a compliant fuel license application. You must apply to the Department of Mineral Resources and Energy (DMRE) for a wholesale or retail license if you wish to purchase or sell petroleum products to the public. The license is valid for as long as your business operates.
The Department of Mineral Resources and Energy (DMRE) is mandated to ensure the transparent and efficient regulation of South Africa’s mineral resources and minerals industry. It secures and sustains the provision of energy in support of socio-economic development. The DMRE regulates and promotes the minerals and energy sectors in South Africa, providing sustainable and affordable energy for growth and development. The Department also ensures that all citizens sustainably benefit from the country’s mineral wealth.
In South Africa, the Mineral and Petroleum Resources Development Act No 28 of 2002 (MPRDA) and the Mineral and Petroleum Development Regulations issued thereunder (Petroleum Regulations) are the national legislation that regulates both the mining sector and the upstream petroleum exploration and production sector.
You are required to include your full name, company name, address, capacity and business registration number on the declarations. You are required sign each of the declarations with your name, along with the date and place. The Commissioner of Oaths is also required to sign the declarations.
There are four DMRE declarations that form a part of a compliant fuel license application.
These include;
- Compliance with the Liquid Fuels Charter;
- Compliance with the Petroleum Products Act, the regulations thereto as well as all other South African laws;
- ‘Company’ is owned by Historically Disadvantaged South Africans; and
- ‘Company’ is currently not in possession of any storage and/or distribution facilities.
It is important to note that not all of these declarations may apply to every fuel business.
