A DMRE BBBEE certificate is a document that verifies your business’s performance with regards to black economic empowerment in South Africa. Broad-based black economic empowerment (B-BBEE) is a policy and legislative framework which seeks to redress the historic economic inequalities created primarily as a result of the implementation of apartheid in South Africa. A BBBEE Certificate is a statutory document required for obtaining a fuel license, as stipulated by the Department of Mineral Resources and Energy (DMRE). Non-compliant fuel businesses will find it difficult to grow or maintain their level of business success within South Africa.

The principal law governing B-BBEE in South Africa is the Broad-Based Black Economic Empowerment Act, No 53 of 2003 (“B-BBEE Act”) and the regulations communicated thereunder (“B-BBEE Regulations”). The principal objectives of B-BBEE are to promote economic transformation and enable meaningful participation of black people in the South African economy, through increased participation in ownership and management structures, increasing the involvement of communities and employees in economic activities and skills training.

• Employment Equity – Hiring practices that encourage fair representation of members of minority groups, women, and individuals that were likely to suffer discrimination.

Businesses with a turnover of less than R10 million do not require a B-BBEE certificate. Failure to comply with BBBEE legislation can result in fines, penalties, and negative publicity for your business. Fuel businesses must then understand, implement, and monitor their BBBEE score to ensure that they are compliant with the applicable sector codes, rules, and regulations in South Africa.
