A manufacturer is someone who manufactures petroleum products and sells them to any licensed wholesaler, licensed retailer, or both. This excludes export purposes. Manufacturers need to obtain a DMRE Manufacturing License for this purpose. You may not manufacture a petroleum product without a manufacturing license.
This is in accordance with the Petroleum Products Amendment Act, 2003 (Act No 58, 2003) – the “Act” Section 2A 1 (a), where a person may not manufacture petroleum product without a manufacturing license. Any person that wants to operate or who is already in operation as a manufacturer of petroleum products must apply for a license. The person must be the owner of the property concerned and if not the owner, must have written permission from the owner.
Steps to Attaining a DMRE Manufacturing License
- You must complete the Application form for a manufacturing license (DMRE 40).
- Send the application form to the Department of Energy regional office.
- The Department will send you a letter stipulating that you must publish a notice of application in four newspapers.
- You must provide proof of the publication of the notice of application to the Department.
- Once you have a license, you must submit information on your business annually using the Manufacturing license annual information (Submission form), DMRE 33.
Costing Structure
- R1000.00 – if you had already been operating before the Petroleum Products Amendment Act, 2003 (Act 58 of 2003), came into effect.
- R10,000.00 – if you were not operating before the Petroleum Products Amendment Act, 2003 (Act 58 of 2003), came into effect.
- R5000.00 – annual manufacturing license fee in respect of petroleum products manufactured from any hydrocarbon including petroleum, crude oil, natural gas, natural gas liquids, or coal or any combination thereof.
- R500.00 – annual manufacturing license fee in respect of petroleum products manufactured from other raw materials.
